IN NO EVENT SHALL NGI, ITS AFFILIATES AND/OR CONTRIBUTORS BE LIABLE TO USERFOR ANY CLAIM RELATING IN ANY WAY TO (A) USER'S INABILITY OR FAILURE TO USE THIS SITE PROPERLY OR COMPLETELY, EVEN IF ASSISTED BY NGI, ITS AFFILIATES OR CONTRIBUTORS, OR ANY DECISION MADE OR ACTION TAKEN BY USER IN RELIANCE UPON THIS SITE’S DELIVERED INFORMATION AND SERVICES; OR (B) ANY LOST PROFITS OR OTHER CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, INDIRECT OR SPECIAL DAMAGES RELATING IN WHOLE OR IN PART TO USER'S RIGHTS UNDER THIS AGREEMENT OR USE OF, OR INABILITY TO USE THIS SITE, EVEN IF NGI, ITS AFFILIATES AND/OR CONTRIBUTORS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NGI SHALL HAVE NO LIABILITY WHATSOEVER TO USER FOR ANY CLAIM RELATING IN ANY WAY TO ANY THIRD PARTY CONTENT OR FEATURE.

8.1 Indemnification. User agrees to defend, indemnify, and hold NGI, its affiliates, contractors, suppliers, directors, employees and agents harmless from any and all claims, costs, damages, judgments, and liabilities (including but not limited to reasonable attorney's fees and costs) made by any third party and arising from User’s use of or access to the Site, any content User posts, submits, transmits or otherwise makes available through this Site, User's violation of the terms and conditions of this Agreement, or the violation of the intellectual property rights of any third party.

9 Limitation of Claims. Except for claims relating to improper use of this Site, no claim, regardless of form, which in any way arises out of this Agreement, may be made, if such claim is brought, under this Agreement more than one year after the basis for the claim becomes known to the party desiring to assert it.

10 Modifications to Terms of Use. NGI reserves the right to modify this Agreement at any time and at its sole discretion. Updated versions of the Terms and Conditions of Use will appear on this Site and become the effective Agreement immediately upon publication. User is responsible for regularly reviewing the Terms and Conditions of Use. Continued use of this Site by User after any such modification of this Agreement constitutes User's assent to such modifications.

11 Entire Agreement. This Agreement embodies the entire understanding between User and NGI with respect to the subject matter herein, and supersedes any and all prior understandings and agreements, oral or written, relating to the subject matter.

12 Force Majeure. NGI's performance under these Terms and Conditions of use are subject to interruption and delay due to causes beyond its reasonable control, such as acts of God, acts of any government, war or other hostility, civil disorder, the elements, fire, explosion, power failure, equipment failure, industrial or labor dispute, inability to obtain necessary supplies and the like.

13 General Provisions. This Agreement will be governed by and construed under the law of the state of Arizona, U.S.A. without giving effect to any principles of conflicts of law provisions. The parties agree that the state and federal courts sitting in Arizona will have exclusive jurisdiction over any claim arising out of this Agreement and each party consents to the exclusive jurisdiction of such courts. Neither this Agreement nor any part or portion may be assigned, sublicensed or otherwise transferred by User without NGI's prior written consent. Should any provision of this Agreement be held to be void, invalid, unenforceable or illegal by a court, the validity and enforceability of the other provisions will not be affected thereby. Failure of any party to enforce any provision of this Agreement will not constitute or be construed as a waiver of such provision or of the right to enforce such provision. The headings and captions contained in this Agreement are inserted for convenience only and do not constitute a part of this Agreement.

Summary of Exclusions of Tuition Refund Insurance

This insurance does not apply to medical expenses of any kind.

This insurance does not apply to loss nor provide benefits as a result of the following:

  1. Change In Enrollment Status
    Change in a “covered person’s” enrollment status. For example, changing from resident student to day student, or a reduction in the number of classes, sessions, or activities.
  2. Criminal Activity
    The “covered person’s” “disability” due to participation in a riot or commission of or attempt to commit a felony.
  3. Dishonest Acts
    Dishonest acts committed by you or anyone employed by you whether acting alone or in collusion with others.
  4. Early Graduation
    The “covered person’s” early graduation or early completion of classes, sessions, or activities.
  5. Government Authority
    Seizure or destruction of property by order of governmental authority which results in partial or complete closure of the institution.
  6. Other Causes Of Loss
    Failure of the “covered person” to attend classes, sessions or activities for any reason that is not listed as a Covered Cause of Loss.
  7. Prior Loss
    Loss of “covered fees” which first occurred before the “covered person’s” “period of coverage”.
  8. United States Armed Forces Draft
    The “covered person’s” induction or draft into the United States armed forces. When, through induction or draft, a “covered person” enters any branch of the United States armed forces, we will refund the unearned premium.

Frequently Asked Questions

Why might Tuition Refund Insurance be right for me?
College is one of the largest investments a family will make, however, it often goes unprotected. If a student is forced to withdraw from school for medical reasons, your family could face serious financial repercussions if your school's tuition refund policy does not apply to the withdrawal's unique circumstance and timing. Tuition Refund Insurance reduces the financial risk inherent in the investment in higher education by refunding lost tuition, academic fees and other related expenses, up to the policy limits, should a student be forced to withdraw for medical reasons.

What is covered by Tuition Refund Insurance?
Up to 100% of covered fees up to the chosen policy limits for:

  • Withdrawal of the covered student from an academic program due to illness or injury.
  • Withdrawal of the covered student from an academic program due to emotional, mental or nervous disorder (a hospitalization stay of at least 24 hours, within 30 days of the date of withdrawal, is required.).
  • Death of the covered student during the dates of coverage.
  • Death of the tuition payer (if different from the student) that results in the student's withdrawal from an academic program.

In order to qualify for "medical withdrawal" the student must have gone through the school's official process for medical withdrawal, and must have confirmation from a physician that withdrawing from the academic program is recommended for medical reasons.

What are "Covered Fees"?
"Covered Fees" can include the cost of tuition, unused room and board, books, and other academic fees.

If a school provides a partial reimbursement at the time of withdrawal, Tuition Refund Insurance coverage will cover any remaining balances up to the policy limits for covered fees.

Coverage is not available if the covered student has:

  • Voluntarily withdrawn from an academic program.
  • Been dismissed from an academic program for academic or disciplinary reasons.
  • Incurred a "loss" (injury, illness or death) that occurs prior to or after the period of coverage.
  • Failed to attend classes for any reason.
  • Graduated or completed classes early.
  • Been inducted or drafted into the Armed Forces.
  • Modified their enrollment status. For example, if the covered student switches from a full-time to a part-time academic program, this Policy would not cover the difference in tuition costs. The student would still be eligible for coverage for tuition paid for their current program, up to the policy limits, should they withdraw for medical reasons.

Who is eligible for Tuition Refund Insurance?
Any student who is healthy enough to begin classes, attending an accredited academic program that offers this Tuition Refund Insurance program, and responsible for tuition costs, may be eligible to purchase Tuition Refund Insurance. This includes students at a college or university program based in the United States. This does not include private high school, professional development or trade school, or other academic programs. Tuition Refund Insurance may not be available in all states. Eligibility and coverage variations are determined by the student’s state of residence defined during the enrollment process.

Is Tuition Refund Insurance available in all states?
No, Tuition Refund Insurance is not available in all states. Availability is based on your resident address listed during enrollment.

What Does Tuition Refund Insurance cost?
Check with your school for details on pricing. Coverage options may vary by school.

When can I purchase Tuition Refund Insurance?
You must purchase the policy prior to the first day of classes.

If I want to increase my limits, do I have to buy more coverage prior to the first day of classes? Yes, a student needs to purchase any additional coverage prior to the first day of classes. You may cancel your existing coverage and re-enroll with higher limits prior to the first day of classes, if you wish to increase your coverage. Coverage options may vary by school.

What is the start date of coverage?
Coverage begins on the first day of school. Nothing is covered prior to that date.

How long does the policy last?
The policy begins on the first day of classes and covers a traditional academic year, including fall and spring semesters. Specialty terms, like J-Terms, may be covered dependent on your school’s program.

Are summer semesters covered?
No, summer semesters are not covered under this plan.

How are the policy limits defined?
The full annual premium is divided by whatever number of terms listed on your Certificate of Coverage. For example, for a student with $30,000 annual coverage, whose Covered Terms are the fall and spring semesters, the student would have the ability to file one claim per semester (2 claims in total), and receive up to $15,000 per semester. If a student attends a school on a quarter system, the coverage limits would then be divided by four.

Am I covered while studying abroad?
Students studying abroad who pay their tuition and fees to their home school, not the study abroad program, are covered.

Are non-traditional programs covered, such as Outward Bound or NOLS?
No, only traditional academic programs that coincide with a standard, school-based academic program are covered by Tuition Refund Insurance.

Are substance abuse and pregnancy covered?
In order to be eligible, the medical withdrawal must be certified by the student's attending physician as being a condition that prevents them from school attendance for the balance of the term. The conditions alone, without a physician's certification of disability, would not trigger coverage. Conditions relating to substance abuse must meet the DSM-IV requirements and have a hospitalization requirement of at least 24 hours, within 30 days of the date of withdrawal. In VT, this requirement is modified to a 2-day hospitalization within the coverage period.

Are mental health conditions covered?
The indicated covered fees will be paid if the medical disability is due to emotional, nervous or mental disorders as certified by a physician. The covered person must incur a hospital confinement of at least 24 hours within 30 days of the withdrawal and completely withdraw from all activities for the balance of the current academic term. The disorder must be officially diagnosed as an emotional, nervous, or mental condition as shown in the DSM-IV manual.

Claims

How do I file a claim?
A student can notify GradGuard of a claim by giving us a call or by emailing claims@gradguard.com. GradGuard will work with the underwriter, Markel Insurance Company, on behalf of the student to process the claim. The underwriter will issue the payment directly.

Who receives claim payment?
Payments will be made directly to the policyholder or to the loss payee as indicated on the member certificate. Claim payments are made once all of the requested documentation is processed and approved. In some cases, the insured's school is the policyholder or loss payee and will receive payment on behalf of the insured. If there are no outstanding tuition payments due, the school will forward the payment to the insured. In instances where the school is not the policyholder or loss payee, payments will be issued to the insured.

What documentation is required to submit a claim?
Students are required to submit a completed claim form, as well as additional verification information from their school and attending physician. For more information on what is required in order to file a claim please email us at claims@gradguard.com or give us a call.

Can a student file a claim for the same condition in each semester?
Yes. As long as the student is provided a clean bill of health prior to the start of the second semester, if the student suffers from the same or similar condition and is forced to medically withdraw again during a new semester they would be covered.

Tuition Refund Insurance

Cell Phone Protection
Most students wouldn’t want to imagine life without a cell phone -what would happen if it was stolen or damaged? Replacing a phone is expensive and a hassle with a busy college schedule. Cell Phone Protection covers damage to or theft of an eligible cellular wireless telephone, up to $200 with a $50 copayment, so replacing a student’s phone is (almost) stress-free.

Identity Theft Protection
Think about how often students use their credit or debit cards at college, grabbing coffee, printing papers, meeting friends for lunch – and that's all before noon. Identity Theft Protection reimburses up to $2,500 of covered expenses should a student experience a covered stolen identity event. This protection also offers one-on-one resolution assistance with fraud specialists should a student need help figuring out what to do.

24-Hour Roadside Assistance
Having a car on campus can be convenient, but what if something happens? With 24-Hour Roadside Assistance, students have round-the-clock help if they find themselves locked out of their car or in need of a tow. This assistance covers up to $80 in service charges per event, including towing assistance, battery service, flat tire assistance, fuel delivery, lock out assistance, and more for the student’s vehicle. Coverage is extended to enrolled members for all vehicles that the enrolled member owns or leases (12 month lease or longer). This benefit includes a four claims maximum per year.

BaZing! Deals and Discounts
The college years can be an expensive time for many families. With the BaZing app, students can save on everyday items with access to discounts and deals on BaZing! Easily find national, regional and local merchant discounts via an online account and smart phone application. This program also includes discounts for pharmacy and vision services outside of the student’s health insurance coverage.

College Parents of America
College life and the details of attending college can get confusing and it can be difficult to know where to turn for advice. College Parents of America is a membership organization dedicated to helping parents and students complete college successfully. With a yearlong College Parents of America membership, parents and students will have access to the College Parents of America Handbook, many online resources, posted scholarship opportunities, as well as a social network of over 21,000 college parents.


If you choose to add a roommate, both people will be listed on the policy. Any check will be issued to both names, and policy limits will be shared for claims filed for the same event. For example, if there was a fire and both roommates had belongings damaged in that incident, the personal property limit would be shared when replacing their items. ×
